Hokki

The rules for using Hokki, in plain language. If something here is unclear, write to us and we will explain it.

01The agreement

These terms are between you and Hokki ("we", "us") and cover the Hokki chat application, the accounts on it and the files you keep there. Using the application means you accept them. If you do not accept them, do not use the application.

We may update these terms. When we do, we change the date at the bottom of this page. Continuing to use the application after that means you accept the updated terms. If you disagree with a change, you can close your account and we will refund the unused part of any subscription you paid for.

02What the service is

Hokki is a chat application. You write to an AI model, it answers, and it can use tools on your behalf: search the web, read and write files, run code in a sandbox, generate images, generate music, and remember things you ask it to remember across conversations.

The models behind it are not ours. We license them from the companies that make them and pass your messages to the one you select. The list of what is available, and what each one costs us, is on the models page and changes as providers add and remove models.

You can use the application without an account. Without one your conversations are not saved, you cannot sync anything across devices, and the tools that need to act on your behalf are limited.

03Accounts

An account is created through Shard ID, our single sign-on service. Signing up gives you a Shard account that works here and elsewhere in the Shard family of services. We receive your account identifier, your email address, your username and your profile picture from Shard ID; we do not receive your Google or Discord password.

You are responsible for what happens under your account, including keeping your sign-in to it to yourself. Tell us straight away if you think somebody else has got into it.

You must be old enough to enter into a contract where you live, and at least 16 to use the service on your own. If you are between 13 and 16, you need a parent or guardian to agree to these terms on your behalf and to supervise your use. We do not knowingly allow children under 13 to create an account.

One account per person. We may close accounts that exist to abuse a promotion, to resell access, or to break these terms.

04Plans, allowances and billing

The free plan has a small allowance that renews. The paid plans cost a fixed amount per month and come with a larger allowance. The pay-as-you-go plan has no monthly cap: you are charged for the models you use, at the rates on the models page.

An allowance is a budget in US dollars of model usage, not a number of messages. It is measured per model, so what you get depends on which models you use and how expensive they are. It refreshes on three rolling windows: five hours, seven days and thirty days. Filling any one of them stops the paid models until that window rolls forward; the free models keep working.

A plan price is a subscription for the month and renews automatically until you cancel. You can cancel at any time from the settings, and you keep the plan until the end of the period you have paid for. We do not charge for a renewal that has already started.

Prices can change. If a price goes up we tell you before it takes effect, and the change does not apply to a period you have already paid for. If a price goes down, the new price applies from the moment it takes effect.

We may change what a plan includes. The plan page always says what a plan includes today.

05Your content

Your messages, the files you upload and the things you ask the assistant to remember are yours. You keep every right you already had in them.

You give us the permission we need to run the service for you: to store your content, to read it back to you, to send it to the model providers you select so they can answer you, and to display it back to you in the application. That permission is limited to what running the service needs. It ends when you delete the content or close the account, except for the parts we have to keep for legal reasons, which are described in the privacy policy.

You are responsible for having the right to send us what you send. If you send something you do not have the right to send, that is on you, not on us.

We do not train our models on your conversations. The model providers have their own policies about what they do with the prompts they receive; the ones we use are listed in the privacy policy.

06What the model gives you back

The model is a prediction engine. It is good and it is wrong sometimes, and it cannot tell you which is which. Everything it produces may contain mistakes, made-up facts, outdated information or reasoning that does not hold up.

Do not rely on it for anything that matters without checking it. Do not use it for medical, legal, financial or safety decisions without a qualified professional. If it says something dangerous, it is wrong, however sure it sounds.

We do not claim that generated content is unique. Two people asking the same question can get the same answer, and the same answer can be produced for somebody else. Do not assume you have exclusive rights to anything the model produces.

You are responsible for what you do with what it produces, including publishing it and relying on it. If you publish it, it is your responsibility to check it and to comply with the law that applies to it.

07Acceptable use

You may not use the service to break the law, to hurt anybody, or to interfere with the service for other people.

Concretely, that means no: content that is illegal where it is produced or read; content that exploits children sexually or that sexualises children; instructions or assistance for violence, self-harm, terrorism or weapons; deliberately spreading malware; sending unsolicited bulk messages; scraping or redistributing the service; and trying to get at other people's conversations, accounts or keys.

You may not use the application to build a competing product by reselling access to it, and you may not use it in a way that breaks an agreement you have with us.

We can and will limit or close an account that does this. Where the law allows, we will tell you why and give you a chance to put it right.

08Third parties and their tools

The service leans on other companies: the model providers, the search and media services the tools call, the sandbox the code runs in, the service that stores your files, and the service that signs you in. Their own terms and privacy policies apply to what they do, and they can change or stop offering what we use.

The tools in the application act on the outside world. A search can return a web page; a sandbox can run code; an image or music generator can make something. You decide when to use them, and you are responsible for the result.

We do not control those companies and we are not responsible for what they do. If one of them goes down or behaves badly, the tool breaks; that is not a breach of these terms.

09Availability and changes

We work to keep the service running but we do not promise that it will be available all the time, or that any particular model will stay available. Providers add and remove models, and some of them have their own outages and rate limits.

We may change or remove features. Where a change takes away something you have paid for, we will either keep it working for the period you have paid for or refund the unused part.

We may suspend or close the service, in which case we will give you notice and refund the unused part of any subscription.

10Liability

To the fullest extent the law allows, we are not liable for indirect or consequential loss, and for direct loss our total liability in any twelve-month period is limited to what you paid us in the three months before the problem happened. Nothing here limits liability that cannot be limited by law, including for fraud or for anything else that would be unfair to exclude.

Nothing in these terms limits your right to bring a claim where you live. If you are a consumer, the mandatory rules of your country of residence apply and take precedence over anything that would otherwise reduce your rights.

11Ending the agreement

You can close your account at any time from the settings. We may close or suspend it if you break these terms, if we are required to, or if the service is being wound down.

When the account closes, your conversations and files are deleted on the schedule described in the privacy policy, and your subscription stops renewing. Anything you still owe for the period you used is still owed.

12Changes and how to reach us

When these terms change materially we will tell you in the application before the change takes effect. Continuing to use the service after that means you accept the new terms.

Questions about these terms, or about the service in general, go to legal@hokki.app.
